USCIS Selects Final H1B Petitions by Random Selection – Almost a 50% chance for each Application

U.S. Citizenship and Immigration Services (USCIS) announced today that on April 12 it conducted the computer-generated random selection process to determine which H-1B petitions, subject to the congressionally mandated H-1B cap for fiscal year 2008 (FY 2008), would continue to final processing. USCIS completed this determination ahead of the preliminary schedule noted on April 3, when it announced it had received enough petitions to meet the cap for FY 2008.

The 123,480 cap-subject petitions received on April 2 and 3 were labeled with unique numerical identifiers and selected randomly by computer. The chosen numerical identifiers were then transmitted to the appropriate service center for further processing.

Number 123,480 looks a lot better keeping in view initial estimates. A good 50% chance for each application to be selected. 

Update: 3rd May 2007 Hello friends, I understand your anxiety. But don’t loose your hope and/or temper yet. Please wait till you receive either your receipt or your petition itself before concluding anything about your application. It is true that USCIS mentioned every one would receive the receipt or the petition itself in 2 weeks, but it looks like it is taking time.

Mean time, some people are even receiving the approvals. So please wait till you receive something from USCIS before planning any changes in your career paths.

Update: 11th May 2007 By today, USCIS would have sent all receipts/rejected applications to all. Give a week or two to receive the communication. So with in a week or two you will have some kind of final confirmation. Congratulations for all those who got your applications accepted and some even got approved already.

  5. No, not to my knowledge. Until the employer receive the receipt, there is no way to know which are selected and which are not.

  6. If the rejection for this year is due to the random pickup then is there any way the USCIS will mark. Because if applying for the next time that will have the bad effect is they check the previous petitions.

  7. No. Applications that are rejected will not be marked. Infact, no data related to rejected petitions is entered into USCIS systems. So no effect for your further applications.

    And its been 23 days already. But my employer says there are no receipt from INS still. Its more than 2 weeks already.
    Are there any chances of the approved reciepts to come last week of April still?
    Because you have told “You should receive the receipt within 2 weeks, so by end of this month you would either receive a receipt or returned application.”
    I mean can i hope for some good luck till 30th or has it been decided already?

    Sonal,
    If your application is rejected, then your employer will get all cheques back. So you can expect to receive all USCIS fees back. But based on my experience, your employer might hold back the amount spent for filing itself (like attorney fee, any edu evaluation or any other expenses etc.). Some employers are giving full amount back to applicants. But this depends on your employer. I do not have any legal background but you should get at least $2600 back.

    Wait until you receive your receipt or application. Though USCIS initially mentioned as 2 weeks, it might take little more time to dispatch every receipt.

  17. I got my approval notice for 2008 H-1B visa on April 19, as well as my new I-94 on April 27th. My H-1B visa process is finally completed. What a relieved, huh? I have a new I-94 because I am in my OPT and it will last till Aug 31, 2007. I don’t have to leave America to apply for visa since my grace period lasts till Oct 31, 2007. Fortunately, my H-1 visa starts on Oct 1, 2007. It was worth to pay premium process since I didn’t have to wait more than a month to know my result. Good luck to everyone.

  18. Hello Friends I have a doubt regarding the random selection process. As USCIS has said that; out of 123,000 applications received, it wud conduct a random selection process. SO here comes the question, How many will USCIS select from those 123,000 through random selection process? is it the final 65,000 cap? or will it select more than 65,000, and then verify all those documents and then decide the applicants who has applied. (OR) to be much simple, say if you got a receipt #, does that mean that you have got the H1 or, what is the next process afte that?

    Any news regarding H1B receipt numbers?

    USCIS will return all petitions not randomly selected for processing, with the fee(s) to the petitioner or their authorized representative. Final notification of those petitions is expected to occur in May 2007.

    My employer said that he filed my H1b Papers on 30th March with INS from vermont center, I have been eagerly waiting since the last 5 weeks for news abt my Application, my employer has told me that he hasnt yet received any info in this regard.
    Can some give me a better and exact information as what Max time it wud take for INS to send the receipt nos, it wud be encouraging if some one cud respond on this I am sure people like me are eagerly waiting..

    If you do premium process, you will know your H-1B result by 15 days. If you do a normal process, you wouldn’t know how long your process will take. You have pay extra $1,000 fee to do a premium process.

    For those who have received receipts # AFTER April 12th , you are selected from lottery system. So, your case will be approved as long as you have met the H-1 visa requirements.

    If you received receipts # BEFORE April 12th, the receipt # is not valid. This is because lottery was conducted on April 12th.

    But there is a way you can confirm this.

    Find out from your H1 filer, if the check given to USCIS for processing has been cleared or not.

    This is one sort of confirmation wherein if the check is cleared, most likely the case has been accepted in lottery .

    In these postings, selected cases are more than rejected cases, i think non selected cases takes more time to know than selected cases.in my friends 4 are selected,1 rejected and 8 members status is still pending. all these figures indicate that non selected applications taking more time to receive notification(application).

    I learnt that by this weekend, 11th of may 2007 USCIS will finish dispatching all notifications ( either receipts or return applications). So give it another week and half to receive some form of notification from USCIS.

  56. That’s true! I’m waiting anxiously like many others. My immigration attorney said not to lose hope as the mailings will be completed tomorrow but will take a few days to arrive by post. So in the early stages of next week, you should either receive a receipt notice or a refusal along with the fees. Best of luck to everybody and keep the fingers crossed.

  70. I think a good way to judge would be, if your cheque has been encashed!
    That would be a sure shot indicator according to me (but dont quote me on this please), if you have been selected or not.
    Cuz they would encash your cheque and start the other processing for you, for others it would make no sense to encash the cheques and then return them….a

    I have received, receipt for my wife on 14th (dated 2nd May). For my application my employer said “still pending”. However there is very less hope coz, for my wife our employer informed on 5th May(I guess they know because cheque has been encashed). But my service center is “vermont” and for that last date is 2nd June..thus still hopeing for the best. Better you can also ask your employer which service center is applicable in your case.

    My H1 application was under regular, cap-subject (Non-Masters degree). My employer has informed that the cheque has been encashed (subsequent to Apr 12th, the lottery day) and has also given EAC reference number. When I checked the status of application on the USCIS site using the EAC ref no., it says that the application is still pending but it does not show beneficiary name. But it shows the processing centre as Vermont. Can I presume that I have won the lottery? I am not sure. Is anyone face a similar situation?

    Mine one is also the same case.I got the reciept and spproval as well.But my husband’s case is “NO Update” .Now what i can suggest you is that try to get L visa for your husband and then he can work there in US.For this search for a company in India right now so that till march that company can file L visa for your husband and in case his current company can get this for him right now or in OCT it will be a best solution as per my understanding.

U must be aware of the fact that uscis issued notices prior to the lottery and later invallidated those receipts. so it is vey important to check the date ur application was received by uscis. hope it is after april 12. good luck….

    I applied for H1b through premium processing. I fall in the 65k quota. Less than 2 weeks ago my lawyers told me I probably didn’t get the H1b because everyone in my company had received their approvals except me, and they had not received anything for me. So I accepted it and moved on to start preparing for plan B thinking for sure it was rejected hence it’s taking so long…

    However on May 14 the lawyer let me know they had received a Receipt Notice from the Vermont processing center. They said they will let me know as soon as they get new information. They did not tell me what this means, yes or no.

    What does this mean ??? After receiving this I have become so anxious, it was better when I thought I had been rejected, atleast I wasn’t thinking about it all the time.

    My lawyer filed my H1B (subject to cap) application via Premium Processing on 4/2/07. But havent heard anything since then… i read in the May 11th Press Release that the extended receipt date does not apply to PP case.. so does it mean those filed via PP should’ve known the result by now already, regardless it’s good news or bad news?

    I got an email from my lawyer on May 9th that they havent heard anything. I’m quite confused here.. Please advise! Thanks!

When I enquired my consultant they said 50% of the people have got the petition approval and I am not the one in that list. It got me in to lot of pressure and it is annoying me a lot.   114. My employer sent me an email aorund May 8th saying that I have been selected in the lottery process and they would be mailing me my receipt number shortly. Till date I have not received the RECEIPT or the SRC/WAN/LIC number as its called. When I enquired , I was told that they are waiting on the status updates of other applicants , for whom they have received neither an ACCEPT or a REJECT and I need to wait max. till June 15th for the receipt number. So they would take some time to mail me the receipt no. I find this hard to digest that becos they are waiting on other applicants status..they cannot mail me the receipt number?? Is there any other way to find out the receipt number, if you know you have been selected in the lottery process?? Is neone out there in a similar situation?? For now, I jus have my employers word that I was selected in the lottery process..No other proof!!

    No your husband canbot get an L visa from a company unless he had worked for that company continously one year in the last three years….
    so i believe that US consultant cannot file L visa for him ..
    ask him to apply through his current company and if he is there for less than one year then wait for the time to complete one year and then try for that but only a company outside US having workforce of a specific amount and some office in US …. there are so many rules to that Visa.On L visa a person can stay there as much time as u can stay on H. but one can’t work on h4 visa so i will suggest you to go for L visa for ur husband and u go on h.Rest is your choice.

    I got my receipt. My application was filed on 2nd April, got selected and notice date was 2nd May. Finally came to me on 15th May.
    So even if your application is selected its hard to predict when will it reach you!
    2nd June is the last date for issuing receipts, so it may take 2 more weeks to get to you.

    Today i called up USCIS customer service and they didnt inform me about my case status as june 2nd is the last date to receive the receipts(as my case belongs to Vermont center)..
    But i tried and tried finally immigration officer asked my first and last name and checked in the DB, said record not found… :-(

    But he said not to loose the hope becuase there is bulk case voulme,so it takes lot of time to enter the details into the system ,send receipts and encash the cheques..

    So all the best for the guys who are not received any receipts or application back..keeping my fingures crossed..

    From the messages that have been posted so far, there seems to be a general belief among the candidates that obtaining receipt number (dated after 12th april) means selected in the lottery. In my view nothing can be taken for granted unless an approval notice is received. Though I have got the receipt number (dated May 2, 2007) and the case is still pending at Vermont centre, I prefer to wait till the approval notice is received as presuming things in matters like this, where there is too much at stake, is not a wiser thing. I would suggest the same (not to presume that they have lost on lottery) to even those who are yet to obtain receipt number.

  132. I see people askig time and again that their cheques have been cleared etc etc. If your cheques have been cleared you have made it through the lottery, its as simple as that.
    There might still be a one in a thousand chance that they migth reject you, but encashing of the cheque is a sur shot signal of the fact that you made it through the lottery. So lets not go in this direction again please…..

    It means you are selected in the lottery, now USCIS will review your education, and your experience. If they find supplied information about your education, and experience is correct, then USCIS will issue the approval notice, otherwise you will get RFE (it means you have to provide more information about the papers you have submitted).

    If you have submiteed correct, and complete information, then no need to worry, you are all set to fly.

    As per my best knowledge geting recpt and approval is two different thing, Once u have recpt you have EAC number you can chk your ECA status from this URL
    https://egov.immigration.gov/cris/jsps/index.jsp

    just click on “online” link enter your EAC number. You can also create account and linkup your application(s) with your account, then u will get automatic mail if there is any change in your application status.

    I dont thing there is any online way to know that number given to you is belong to you application only…but most closly 2 ways..first you can ask ur recpt copy from ur consultant ..your name should b there OR you can check online your application status and if the type of applicaion is same then u can guess may b its ur only.

Actually, my employer cudn’t submit my I94 form as I had been to India for 3months and came on april 2nd.   203. The USCIS has approved 41,000 cap-subject cases and 12,500 U.S. master degree cases as of now. They have issued about 10,000 RFEs for cap-subject cases which are pending. Approximately 4,000-5,000 RFE have been ossied for U.S. master degree cases and they are in this regard still pending. They held-up approximately 1,000 cap-subject cases for potential availability beyond those cases which had been selected, it appears that these may be rejected and returned. For the Chile-Singapore cases, they have already exhausted the special number for these cases and there are no numbers that add to the cap-subject quota from the Chile-Singapore unused numbers.
    By now, they fixed no-winners in the lottery. There has been some delay in sending out rejection notices and return of checks. These rejection notices and return checks will be completely mailed by July 20, 2007.
    The California Service Center has been experiencing delays in processing of receipt or approval notices for the selected cases and approved cases. Soon, the CSC will post a special email number for inquiry of these cases on the USCIS website.

The prioritization of data entry for specific form-types was a proactive measure on the part of Service Centers to address the unprecedented level of H-1B filings received on April 2nd and 3rd, 2007, as well as the unprecedented level of filings for other immigration benefits. USCIS would like to assure its customers that the delay in data entry and fee receipting will not affect Change of Status or Extension of Stay eligibility, assuming all other eligibility requirements are satisfied. USCIS would also like to assure its customers that per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the “Received Date” box on Form I-797, Notice of Action. The received date is different from the “Notice Date”, which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated.

    Please can anybody guide us, is this correct scene from my employer, or they are fooling me.

    Please are there any other means to get some update, without bring employer in contact, as like a direct call to USCIS.

    After long wait, my employer had mailed me, my reciept no,. which they got yesterday, it was selected in lottery on 21st april, my case is Recieved & Pending, as found on USCIS site.,
    So frnds keep your hopes and beliefs high, things can happen in last moment.
    But now queries are more that, pending will get approval when, by what time., but yes now i feel its like, california centre is moving with low pace, so can’t judge, and estimate, so better to wait with faith and hope.

    Afraid to share my analysis it may be incorrect it is purely my opinion. it looks like center is processing in alphabetical order as I have seen my friend case whose name was starting with a letter A has got his approval very early… my name starts with R … so I have got approval after 2 months of him. STILL 4 more letter are left i.e STUV whose application may be processing ..if you have not got any RFE then dot worry have patience you will get approval after a while …

    Congrats for the approval man…. u must b sooo relieved… I knew that it was going on alphabetically as it was taking too long for people with name starting with P,R,S and so on… which includes mine as well … but whtever be the case.. I am still waiting for any update about the approval… and I would continue to… Hopefully I should get an update in a day or so.

    Best wishes to all who are waiting like me!!!! And Congrats to all those who have already got the approval notice.

    Does anyone have a pending case at the california center? My receipt date was 20th april but still no news. The only info I have frm my employer is that they requested for additional evidence which does not reflect on the USCIS website.

    I tried calling the rep at USCIS but they say that they give info only to the petitioner and not the beneficiary!!!
    Anyone stuck in the same situation?

    It is not possible that your record is not found.Either u should have received approval or u were out by lottery draw or u r petition was not kept at all.They have finished all pending works what they are telling.So,if till today ,u have notreceived anything,it is a matter to think.tk cr.

    I finally got my approval. The website reflects 10 Aug as the notice date.
    My receipt date was 20th Apr @ calfrn cntr. So i guess others who have the similar dates and centre would get it soon.
    Also in my case USCIS had requested additional evidence and i got approval within 15 days of it.
    Hope this helps people stuck with pending case.

    A friend of mine had applied the employer said its rejected and they refunded
    the whole money. But inspite of repeated request they never provided the receipt number.
    I believe at leaset by now you should have received the receipt number.
    May be you can call USCIS and check if there is any application by your name.

  275. You are definitely selected in lottery. Probably they might require additional evidence but they will let you know. My case was also pending for a very long time and then they asked for additonal evidence and I provided and now it got approved.

    I got my approval letter. In my letter its mentioned Class Consulate or POE H1B KOLKATTA.

    Does it mean that I can get my Visa Stamped only at Kolkata Embassy?

    Or Can I get it stamped in any Amrecan Embassy?

    Atlast after getting RFE i got my approval with god’s grace,but again another obstacle.One of my friend who applied for the same consultant got rejected because of petitioner problem,Now i have to go to the same consulate for the same consultant.Everybody are telling 90% sure that mine too will be rejected.Do anybody suggest any idea to avoid it.

  304. The CIS reports having completed data entry on all cases selected in the H1b lottery on May 23, 2008 and all receipts were issued by May 24, 2008. They have also stated that they have sufficient applications accepted so that a ‘cushion’ will not be needed this year and they have begun to mail out rejections for reserve cases (i.e. wait list) this week. The CIS currently has approximately 500 petitions they believe are duplicates and are in the process of hand reviewing these cases. Any of these cases that are determined to be actual duplicates will be rejected and those that are not will be accepted.
